Yes, it is possible. He could have used those five minutes to jailbreak the phone and install a spy program that can be detected by experts. Record his conversations, collect some other evidence that makes you suspicious about his knowing what he cannot know: in court, he will likely be asked to present his monthly bills (spy programs usually bill the person).
