Minor scratches will not be taken care of by the towing company. However, dents and other damage -- including damage that could render the car in-drivable -- can be covered by the towing company.

To make the towing company pay for damages:

  • Take your car to three separate body shops for estimates.
  • Let the mechanics explain how the damage could have been caused and get the estimates and reasons in writing.
  • Write a letter to the towing company asking that they pay for the majority of the bill since they were the ones who damaged your car.
  • If they refuse and you still believe you are entitled to payment, you can take the company to small claims court.

What's the law if you can't pay your car that is about to get towed?

I got my car towed today and when I went to pick up my car he asked me to pay a fine of $125 cash only. When I told him I don't have that much cash and can he accept the credit card he refused and said cash only. He then sent me along with one of his employee in his car to ATM station. ATM machine was a little far away and we got late. By the time we came back it was 30 minutes to 45 minutes late and he said he is now going to charge me $155. I requested him I don't have that much cash, begged him, went down on my knees to request him and told him I am just a student who can't pay that much. He didn't listen to me and used profanity against me and only let me take my car when I paid $155. I want to file a civil complaint against him. How can I do that?

Hi, Do you have any other suggestions on how can I prevent my car from being repossessed?

I was reading the information on how to prevent your car from being towed. I am in a situation where I need to gain some extra time in making a car payment so I need to hide my car or prevent it from being towed.. I have tried: I have made numerous attempts to get a further extension from the lender but to no avail. They will not work with me.. I think it was caused by: I lost my job recently so it has been difficult to make my payments. I am one payment behind.
